Council adopts zoning text amendment to align pool barrier rules with 2024 code

Community Development Manager Hon presented the second reading of Ordinance 26‑14, which updates chapter 27.79 of the city ordinances to align local pool barrier requirements with the 2024 International Swimming Pool and Spa Code. The amendment gives property owners two options: install a six‑foot fence where a permit is required or, alternatively, use a code‑compliant automatic pool cover and a four‑foot barrier when the cover is used. The ordinance also tightens required gate hardware, specifying self‑closing, self‑latching, and lockable devices.
Councilman Shetty raised concerns about above‑ground pools that often do not require permits and therefore may lack added protections; he reiterated his prior year’s no vote reasoning that an extra two feet provides additional safety for children. After discussion, the council approved the amendment on second reading.
The ordinance goes forward with the code options and additional gate hardware requirements; staff will incorporate any administrative changes necessary to implement the code alignment.
