Arkansas Code Revision Commission approves draft recodification of Title 19

The Arkansas Code Revision Commission approved a proposed draft recodification of Title 19 at its Oct. 17, 2024, meeting in Little Rock.
Commissioner Camille Bennett, the commission's representative to the Title 19 Recodification Working Group, told the commission the 11-member group recommended that the working group's draft be introduced as a bill in the next legislative session. The working group included representatives from the Code Revision Commission, the governor's office, attorney general's office, treasurer's office, auditor's office, Legislative Audit, the Department of Finance and Administration, the Department of Transformation and Shared Services, the State Claims Commission, the Ethics Commission and the Arkansas Bar Association.
Senator Joshua Bryant asked why the working group recommended transferring certain workers' compensation provisions involving state employees to Title 11 rather than Titles 21 or 25. Kevin Koon, Arkansas Code Revisor, and Commissioner Bennett explained the working group's reasoning and said Bureau staff and the working group would assist the legislative members of the commission as the Title 19 recodification bill is drafted and presented to the General Assembly.
Representative Jimmy Gazaway moved to approve the proposed draft recodification of Title 19; Commissioner Vaughan Hankins seconded the motion. The commission adopted the motion.
Kevin Koon later told the commission staff is evaluating publication issues that may arise from the recodification and recommended including savings provisions in the Title 19 recodification bill to prevent conflicts with laws enacted during the 2025 regular session. The commission did not vote on specific savings-language at the meeting; the next step identified was drafting and introducing the recodification bill in the General Assembly and coordinating with legislative members to address subsequent issues if they arise.
The commission adjourned after completing its business for the day.
