Leach field replacement (77 Center Street): David Bennett of Shore Place Environmental described a Title 5 replacement of a failed leach field at 77 Center Street in Dennisport; commissioners raised a minor planting suggestion and a groundwater separation question. The commission closed the hearing and issued a Positive 5 determination (area is subject to review under the bylaw) and a Negative 2 determination (work is within jurisdiction and will not alter the resource area).
Pool and patio (37 Stephen Phillips Road): Craig Ferrari (Down Cape Engineering) presented a small pool and patio proposal located about 89 feet from the bordering vegetated wetland; the applicant proposed a full drawdown pit to avoid discharging water to the wetland. 3 Port Way (notice of intent): Down Cape Engineering described a full house replacement with a new septic (including an IA component), relocation of a driveway out of the 50‑foot buffer and a separate forthcoming bulkhead project. Commissioners approved motions to close the hearing, agreed to grant necessary variances and asked staff to draft an order of conditions.
Lighthouse Inn enforcement: Gregory Stone of the Lighthouse Inn acknowledged that heavy equipment had been used on the beach during shorebird nesting season and apologized. Commissioners asked for a written seaweed management methodology and advised Stone to obtain Natural Heritage approval before using motorized equipment during nesting season; they also advised submitting the citation payment through the town clerk.
Administrative and scheduling items: The commission signed an order of conditions extension (bond #16-245457 HorseFoot Road), approved a certificate of compliance (SD16-1612), and approved minutes for several 2021 and 2025 meetings. Staff proposed rescheduling a Sept. 23 work session (to cover draft rules for vista pruning and invasive management) to Oct. 7 as first choice and Oct. 28 as backup; members agreed to the change subject to room availability.
