The Sunset City Planning Commission postponed consideration of proposed changes to the city's accessory dwelling unit (ADU) regulations after commissioners identified inconsistent drafts and several unresolved technical items.
Chair opened the discussion by describing a proposed amendment to Title 10, Chapter 12 to add external (detached and attached) ADUs and said the primary goal was to ensure the code "is compliant with the state code" adopted in the last legislative session. Commissioners discovered two different versions of Chapter 12 in the meeting packet — a prior discussion copy and an editable proposed copy — and flagged a sentence in one copy that said “detached ADUs are not permitted in any zone,” which conflicts with state direction to allow ADUs in many residential areas.
The commission spent the most time on design and operational standards. To "maintain the appearance of a single-family residence," the body accepted a proposed standard that an ADU must have a separate entrance and that the ADU entrance "shall not be on the same face as the entrance for the primary residence," language intended to prevent simple duplex conversions, the Chair said. The commission also reviewed addressing rules (ADUs keep the same address but may be designated as "Unit B"), minimum unit standards, and parking requirements, including a clarification that converting a garage into an ADU requires the property to provide an additional off-street parking space elsewhere on the lot.
Commissioners directed staff to reconcile the editable draft with the attorney-reviewed language and to add missing items for detached ADUs (utility connections, setbacks and any distinct sewer/water requirements). Commissioner (speaker 4) moved to postpone the recommendation that would send the amended Chapter 12 forward to city council; the motion received a first from Commissioner Harwick and a second from Commissioner Page and passed unanimously.
The commission did not take final action on the code changes; staff will prepare a consolidated draft that incorporates attorney input and the commission's edits for review at a future meeting.
