Board grants side-yard variance for condenser after permit error cited

Eugene Pelos told the Board of Adjustment the mini-split condenser at his Hillside Avenue home was installed in July 2024 and that the installing contractor mailed a permit check that was lost in transit, prompting the current variance request.
Pelos testified the unit is located about six to seven feet from the side-yard property line where 10 feet is required and that relocation would be costly because it would require rewiring. He also said the unit is "a ductless split unit" that produces "about 52 to 58 dB," which he characterized as similar to a quiet street or a refrigerator.
Board members reviewed the survey location, discussed distance to the neighbor's house and whether the unit could be placed in the rear without a front-yard encroachment on the corner lot. No public objections were recorded. Vice Chair Mark Cunningham and other members said the placement did not present a significant detriment given the unit's noise level and location.
The board moved and unanimously approved the side-yard variance with the condition that the applicant verify the condenser location on the survey and comply with any inspection requirements.
