HDC debates codifying Old Town guidelines and formatting changes to improve clarity

The Historic District Council spent an extended portion of its May 15 meeting discussing the future of Old Town and downtown preservation guidelines and how best to make them usable and enforceable.
Staff said the 2021 Old Town guidelines and the newer downtown draft were intended as guidance documents and that adopting the entire guideline text by reference into the Land Development Code could create application problems because many guideline passages are intentionally flexible. Kelly, the planning staffer, advised that adopting the whole documents as law could force more applicants into variance processes and suggested extracting a short list of codifiable, objective items — for example setbacks, roof heights and specific sign definitions — that the council wishes to make enforceable.
Board members debated formatting and accessibility: several advocated copying the Old Town document’s clearer information flow and graphics, while staff and the consultant cautioned that downtown’s complexity requires different presentation and page size to convey detailed guidance. Members asked staff to deliver a targeted list of 'sacred cows' to consider for codification, an index or cross‑reference aid, and cost estimates for remediating format and photo updates. The council asked staff to return with concrete recommendations and case studies from other jurisdictions and to work with the consultant on practical changes to the document’s style rather than re‑writing content in house.
The board also discussed public outreach and the role of charrettes and focus groups in past guideline development; staff said prior charrettes informed the 2021 Old Town guidance. Members requested clearer instructions for applicants and suggested distributing concise informational packets to realtors and property owners to reduce confusion about district obligations.
