Staff propose links and chapter-level notes to help readers trace repealed RCW chapters

Kevin presented proposed updates to the RCW disposition tables to help readers trace repealed chapters to successor material without editorializing.

Kevin explained that each disposition entry would include a hyperlinked ‘‘repealed by’’ session-law citation so readers can click through to the session law that effected the repeal and view the new chapter text. He also proposed appending a chapter-level cross-reference note (in italics) directing readers to a likely related chapter, following patterns used elsewhere in the RCW base. Kevin told the committee these changes require a software update from Legtech before they can go live and that staff are proposing to add such notes retroactively back to about 2020 where a clear successor exists.

Former municipal court judge Anne Levinson said the existing wording that simply states “repealed by [year]” can mislead nonexperts into thinking the legislature abandoned a policy. She urged adding plain-language direction such as “see chapter X” so readers can find current law without staff adding policy commentary. Kevin and other staff said the office will err on the side of caution when the relationship between repealed and successor material is complex and will rely on readers to consult the session law when necessary.

Committee members generally supported the goal of improving navigability while avoiding editorial conclusions about legislative intent. Staff will run the proposals through the office’s editorial process and coordinate with Legtech on the software changes required before publishing.
