Commission recommends municipal-code changes on development agreements and conditional uses; continues fee-schedule update

The Emigration Canyon Planning Commission on June 11 recommended two municipal-code amendments to the Emigration Canyon Council and continued consideration of updates to the land-use fee schedule.
Planning Manager Brian Tucker presented proposed code changes to enact Chapter 19.03, Development Agreements, and to repeal and replace Chapter 19.84, Conditional Uses. Commissioners discussed formatting and title wording, and confirmed that Council-adopting-ordinance language would apply to both code sections. Commissioner Jodi Geroux opened the public hearing; no members of the public spoke.
Commissioner Jodi Geroux moved and Commissioner Jim Karkut seconded to recommend OAM2026-001637 (enacting Chapter 19.03) to the council with the formatting and adopting-language adjustments discussed; commissioners voted unanimously in favor. For OAM2026-001638 (repealing and replacing Chapter 19.84), Commissioner Geroux moved and Commissioner Dale Berreth seconded; the motion passed 4–1 with Commissioner Andrew Wallace voting no.
Separately, the commission considered OAM2026-001636, a proposed resolution amending Emigration’s land-use fee schedule, and voted to continue that file to the July 9 meeting. Commissioner Andrew Wallace moved to continue; Commissioner Jodi Geroux seconded and the motion carried unanimously.
In routine business the commission approved minutes for December 11, 2025; January 8, 2026; and March 12, 2026, each with two clarifications. Motions to approve those minutes passed unanimously.
The record notes the commission reviewed statutory bases for potential closed-session topics under Utah Code §52-4-205 (personnel, litigation strategy, real-property strategy, security deployment and other lawful purposes). The meeting adjourned at 10:26 a.m.
