Middletown debate narrows on noise ordinance changes; riverfront exemptions draw concern

MIDDLETOWN, Conn. Aug. 5, 2024 City legal staff outlined a revised substitute to Middletown's noise ordinance that narrows permitted hours for lawn and construction work and adds special provisions for riverfront performance venues, prompting questions from council members about enforcement and exemptions.

Attorney Smith said the substitute reduces permissible hours for lawn care and maintenance equipment to 7 a.m. to 8 p.m., and changes construction activity rules so that allowable times run from 7 a.m. to 8 p.m., Monday through Saturday, rather than ending one hour after sundown. "So instead of allowing it from, 7AM to 8, 9PM, it allows it from 7 to 8PM," Smith said, summarizing the lawn-care change, and described proposed Sunday-Thursday curfews of 11 p.m. and Friday-Saturday curfews of midnight for designated riverfront/event locations.

The central dispute in the workshop was whether the ordinance exemptions for some riverfront spaces would leave the city without practical controls over noise. One council member warned the exemptions would make those entities "totally exempt" from the ordinance and said the venue in question has not yet received required planning and zoning approvals.

Attorney Smith responded that while the substitute contains exemptions, the citystandard leases contain enforcement tools. "So 1 is there is a, a nuisance provision... 2 is there is a reputational clause in our standard leases," Smith said, adding those clauses give the city remedies under common-law nuisance or reputational harm even if the ordinance does not apply.
