Board continues Neilan after‑the‑fact shed case pending survey and impervious‑surface calculation

The Morrison County Board of Adjustment on July 7 voted to continue an after‑the‑fact variance request by Nicholas (Christopher) Neilan for a large shed placed within shoreland setbacks at Lake Alexander. Land services staff told the board the department discovered multiple unpermitted structures in November and had treated two small sheds as replacements while concentrating enforcement on the larger shed; staff said the larger structure had at times been used for sleeping quarters and that initial discussions in 2020 had not resulted in an application.

The board raised questions about impervious surface coverage, a shed staff had not shown on the applicant’s site plan, and the intermittent presence of recreational vehicles. Neilan estimated impervious cover near 13% for the north side only; staff said surveyor documentation and an impervious‑surface worksheet are required to verify total coverage across both sides of the road. Staff noted it had previously waived the boundary survey but that given the newly identified additional structures and fence, a surveyor’s measurements would be required this time.

George moved to continue the application pending a surveyor’s impervious‑surface calculation and an amended application that includes all structures; Clint seconded. The board voted unanimously to continue the matter, with staff to send a letter and relist the application once documentation is received. The continuance does not require an extra fee for reapplication.
