Town Clerk/Treasurer Richard Kohler told the council that Clevenger submitted a resignation letter to town staff on April 22. Kohler said the town’s charter governs vacancies: Section 2.08 addresses vacating office upon resignation, Section 2.09 requires Council appointment when the next election is more than one year away, and Section 2.03 sets eligibility requirements for successors, including at least six months’ status as a qualified elector and the collection of required qualifying signatures.
Kohler said staff set a 14‑day qualifying period beginning at 9 a.m. Tuesday, April 28, and ending at 4 p.m. Monday, May 11. He said staff will present any applicants who meet the charter qualifications to the council at the May 18 regular Town Council meeting (RTCM) for appointment. Mayor Steve Rivet and Town Attorney Karl Bohne confirmed to the council that the shortened qualifying window meets the charter’s timing requirement.
Council Member Wayne Abare moved to accept the resignation; Council Member Marisa Acquaviva seconded. The motion was recorded as carried unanimously, noted as “All Ayes” with a 4‑0 tally. Council Member Frederick Heiler moved to accept the qualifying dates as proposed; Acquaviva seconded that motion as well, and the council again voted unanimously (All Ayes, 4‑0). The minutes do not record individual roll‑call votes.
The meeting also included a brief roll call and announcements from Clerk Kohler that there is one vacancy on the Planning & Zoning Board and one vacancy on the Trails and Greenways Committee (no vacancies were listed for Parks and Recreation). With no further business, Mayor Rivet adjourned the meeting at 6:36 p.m.
