The city attorney explained the background for the larger settlement, which involves an 11‑year‑old who sustained permanent elbow injuries after being knocked off a city slide at a camp.
The attorney described prior mediations, an impasse at the plaintiffs' $190,000 demand, and subsequent negotiations after a witness changed testimony. The settlement described by counsel allocates approximately $50,000 in attorney fees and about $92,000 placed in a structured settlement vehicle for the minor, for a total city cost in the $142,000 range. The attorney said the structured portion would be held until the child reaches majority.
Several commissioners asked why they had not received detailed backup earlier and urged that the commission receive similar memos in advance for future settlements.
