The Jefferson County Planning and Zoning Commission approved a variance Jan. 8 allowing a permanent shed owned by Albert and Kaylee Schellenberg to be 3.5 feet from the property line where code requires 5 feet for lots under one acre.
Applicant Albert Schellenberg told the commission the shed was placed to meet dwelling setbacks and that he and his wife "didn't know the shed needed a permit" and that nearby properties have similar sheds. Kaylee Schellenberg said the setback is a recent requirement tied in part to FEMA rules, and the applicants provided photos and a letter to staff.
Commissioners questioned whether the hardship was self-imposed. Commissioner Sean Priest said setbacks "are for safety and comfort" and noted that self-created hardships complicate variance findings. The commission approved the variance with an added condition requiring a one-hour fire-rating for the structure. The motion carried with three recorded affirmative votes and two recorded negatives; the staff-recorded outcome was approval with condition.
Chair Warren Albertson clarified the approval applies only to the existing building. Planner Jenna Huennekens and Planning Administrator Milton Ollerton participated in the discussion and recommended the fire-rating condition.
