Petitioner withdraws occupancy variance, submits updated plans and septic report

At the July 16 rehearing on petition 26O32, petitioner’s attorney Michael Roth asked the board to adopt the prior hearing record and said the petitioner no longer seeks a variance on the number of occupants. "We are waiving our request for that variance," Roth said, removing the occupancy exception from the current application.
Roth offered three exhibits for the record: an updated floor plan (referred to as exhibit 6), an accessory dwelling reconversion plan (exhibit 7) and a soil evaluation/septic renovation plan (intended as exhibit 8). He explained the reconversion plan is required by code so the property owner has a plan to deconvert the accessory dwelling unit if it ceases to be used as such.
Roth said the septic evaluation and renovation plan were prepared in August–September 2025 and that those documents would be submitted to the DuPage County Health Department for approval if the zoning petition is granted. He noted the physical work to modify the septic system had not yet been done because approval is uncertain.
