School district objects; commission postpones Rolling Rock and Seville plats to Sept. 8

The Hernando County Planning & Zoning Commission postponed consideration of two conditional plats—Rolling Rock (file 1498214) and Seville Phase 1—until a date-certain hearing on September 8 to allow the school district and developers to finalize proportionate-share mitigation agreements and concurrency certification.
James Lipsey, representing the school district, told commissioners the county’s ordinances require a certificate of concurrency for schools before certain approvals and that legally binding proportionate-share mitigation agreements must be executed prior to issuance of subdivision approvals. “We are formally objecting to the conditional plat approval at this time,” he said, noting the district expected to approve template agreements at its September 9 school-board meeting.
Developers said they had reviewed and were prepared to sign agreements from their side. Developer Trent Stephenson told commissioners his client is ready to proceed if the parties can agree in short order; Clearview Land Design’s Brian Surak similarly asked the board to consider the practical cost and schedule impacts of further delay.
Commissioners struck a compromise: rather than approve under the staff performance condition, they postponed to a date certain so the county, school district and applicants could finalize paperwork and avoid setting a legal precedent. The postponement was introduced by Commissioner Mike Fulford and seconded; the board confirmed the date-certain hearing for September 8.
What’s next: Staff and the parties will work to finalize proportionate-share mitigation agreements and concurrency determinations; the plats will return to P&Z on September 8 for final action.
