Staff proposes code language requiring private detention maintenance and record-keeping

Christian Summers, assistant director of development services and the city's floodplain administrator, presented draft additions to Section 9.72.D that would require private detention facilities to be maintained in operational condition and preserve their designed storage volume. "Private detention facility shall be maintained in operational condition at all times," he told commissioners while displaying proposed text and examples of required language.

Summers said the proposal would also require maintenance records to be provided upon request and that staff was considering an annual, semiannual or biannual reporting cadence. "Where applicable, detention facilities upon reasonable notice and failure to maintain detention facilities in accordance with this code, shall be considered a violation of the code," he said.

Commissioners asked practical questions about inspecting subsurface or underground detention and who would be responsible for ongoing reporting. Summers acknowledged inspection challenges for subsurface storage and said the city would require a responsible party and written reports to enable enforcement. He cited recent local projects that use underground detention, noting examples in commercial parking areas.

The commission did not adopt formal language or a motion at the meeting but directed staff to continue refining the draft and bring back details on enforcement mechanics and inspection protocols for future meetings. The discussion included coordination with Chapter 9 (residential drainage) to ensure consistent standards across commercial and residential projects.
