Developer’s Planned Unit Development raises wetland and access concerns; Board asks for further review

Randy Jenniges, a civil engineer with Short Elliot Hendrickson Inc., presented a Letter of Understanding for a proposed Planned Unit Development on property subdivided in 2022. The proposal would impact a portion of a Wetland Conservation Easement and requires a wetland crossing to access the western portion of the property; the landowner requested conditional consent to initiate a Wetland Replacement Plan via the Technical Evaluation Plan (TEP) coordinated by the Cass County SWCD.
Jenniges said an Environmental Assessment Worksheet (EAW) has been submitted and is under agency comment. County staff told the board that County policy requires a completed Wetland Replacement Plan before Preliminary Plat review to avoid later layout changes. The Board expressed concern that a provision in the Letter of Understanding (item 3.4) appeared to remove Board discretion and requested a study addressing staff concerns and the Planning Commission’s proposed approach. Representatives of Friends of Gull Lake also voiced concerns over the proposal. The Board took no action and asked the developer to return after the EAW and TEP reviews and Planning Commission input.
