Council grants special use permit allowing large accessory structure at 2906 Toler Drive

The Rowlett City Council voted unanimously to approve a special use permit allowing an accessory structure larger than 500 square feet at 2906 Toler Drive on Aug. 19.

Staff described the property, explained that the structure was erected before required permits were finalized, and said the case resulted from code enforcement. The presentation included lot‑coverage, setback and height calculations and noted that Planning & Zoning recommended approval 4–1 with conditions that the accessory structure meet all code requirements.

Council members questioned whether inspections occurred during the concrete pour. Staff said they did not recall inspections taking place during construction. "I do not recall that an inspection occurred at the time, Council," staff said, and attorneys explained that approval of the SUP would make the zoning compliant but separate building‑code inspections and potential variances (for setbacks or similar) may still be required before a final building permit could be issued.

Several councilmembers expressed concern about repeated retroactive permit requests and asked about enforcement options, including higher fees for retroactive permits. The council ultimately approved the SUP and instructed staff to ensure required building inspections and any additional permits or variances are addressed.
