Committee backs stronger enforcement language to require repairs for curb and right‑of‑way damage

Town staff proposed code language intended to give enforcement authority when contractors damage the public right‑of‑way, swales or curbs during construction. Heidi Siegel said the changes would allow the town to require repairs and to use certificate‑of‑occupancy conditions to ensure damage is fixed before a final sign‑off.

Siegel described introducing preconstruction photo documentation and said the town has previously refused to release permits when prior damage was not repaired, which prompted contractors to fix curbs within 24 hours in past cases. 'At the end of the day, we hold the power on these projects with the certificate of occupancy,' she said. Committee members asked how staff will prove responsibility for specific damage; staff said contractors will be asked for preconstruction photos and staff will document conditions during preconstruction meetings.
