Developer: Apollo Estates detention pond will be relocated and developer will assume costs

Town staff introduced agenda item 3C as a preliminary plat for Apollo Estates, a proposed subdivision of 318 single-family homes and 14 open-space lots. "The purpose of the preliminary plat is to construct the subdivision, consists of 318 single family homes and 14 open space lots," staff said during the presentation.
Warren Corwin of Corwin Engineering, the applicant’s engineer, told commissioners the temporary detention pond in the northwest corner was placed by Heinz and that the developer plans to relocate stormwater storage to the east side and provide a regional detention facility serving the entire tract. "That detention pond is on the Northwest corner was put there temporarily by Heinz... That will be relocated to the east side of the property where there'll be a regional detention for the entire tract," Corwin said. Developer representative Andrew Shaddock told the commission the developer will take full financial responsibility. "We would take over full responsibility and financial responsibility," Shaddock said.
Commissioners asked for detail on who would construct and maintain the relocation and whether the relocation imposed any obligation on the current neighborhood. Corwin said engineering work will relocate the pond and the developer would handle construction; Shaddock said the developer prefers to control construction to "handle our own construction and control our own destiny". The commission did not vote on the technical detention plan at this meeting and tabled the item to allow more information about HOA and amenity arrangements to be finalized.
