The Clinton County Zoning Board of Appeals on April 21 postponed action on a variance application for 4354 W. Lehman Road in Riley Township after the board concluded additional information and revised plans were needed.
Interim Planning & Zoning Director Lynn Wilson presented the request by Mary Henningson. Wilson said the existing, legal nonconforming structure sits 9 feet from the road right-of-way while a 50-foot setback is required; the proposed addition would increase the degree of nonconformity and would exceed the 50% limitation on first-floor expansion for nonconforming structures. Lynn Wilson noted that "an adjusted proposal may reduce the extent of the non-conformity, but she was unable to confirm compliance without a revised proposal with dimensions." The applicant was not present for the meeting.
Board members asked whether the proposal could be modified (for example by detaching the garage) or whether physical constraints like floodplain or topography might justify the variance. Kathleen George moved, supported by Keith Jones, to postpone action on Variance Request ZC-02-26 (PVR260002) pending additional information necessary to determine whether the seven general and three special variance conditions are satisfied. The motion carried unanimously by roll-call vote (5-0). The board requested a revised proposal with dimensions to allow staff and the board to reassess the request.
