Planning and development director Matt Adams told the council that the applicant for PZ 20251574 is seeking a variance “to allow a commercial dumpster to be located in the side yard rather than the rear yard as required by the UDO.” Staff’s analysis, Adams said, found the dumpster’s access arrangement predates the current owner and that strict application of the Unified Development Ordinance would create an unnecessary hardship.
Adams recommended approval with conditions, including that the development be constructed in substantial conformity with the site plan received by planning on 11/17/2025 and that the applicant provide confirmation they have obtained permission to use the neighboring driveway for access and servicing of the dumpster. A representative for the applicant spoke in support and reserved time for questions. No speakers registered formal opposition at the hearing.
If approved with the staff conditions, the proposed wooden enclosure would screen the dumpster and, staff said, “improve the site’s appearance along Pierce Drive and the private driveway” while maintaining safe access for collection vehicles. The council did not take a final vote during the work session; the item will return at a subsequent meeting for final action.
