Committee debates private-road maintenance agreements and emergency-access implications

Jefferson County staff and committee members discussed the increasing use of private roads in subdivisions, the county's requirement for private-road maintenance agreements, and the legal and operational ramifications for emergency services and law enforcement. Josh Fielding said the county requires a signed private-road maintenance agreement among owners and suggested adding a clause to acknowledge emergency access. "When someone creates a private road, we require a private road maintenance agreement that must be signed by all owners that utilize the road," Fielding said.

Vernon Ulrich and others warned about potential legal challenges if residents try to block emergency access and about the burden private roads place on law enforcement and ambulance services. The committee discussed alternatives such as dedicating right-of-way to the public while leaving maintenance private (a model used by some neighboring counties) and agreed to consult legal counsel and finalize language for maintenance agreements and resolution routing to the Commissioners.
