Comal County Commissioners on Feb. 13 approved an order granting a discretionary exemption to procure Hart Intercivic's annual Verity software license and support from the single supplier.
Elections/IT staff said Hart Intercivic is the manufacturer and sole provider for Verity and cited the Local Government Code exemption for items available from only one source. "Hart intercivic is the manufacturer and sole source provider of software licensing and support for the Verity voting equipment," Mr. Davila told the court, and staff submitted a sole‑source justification. The court approved the exemption by motion.
Staff explained the exemption is consistent with code language allowing procurement without competition when competition is precluded by patents, copyrights or other exclusive rights. The order approved at the meeting allows renewal of annual software licensing and support for the county's Verity voting equipment.
