Commission adds ADA exemption language to zoning permit rules

The Windsor Planning Commission decided June 25 to revise Article 6 of the proposed zoning bylaw amendments to expressly exempt modifications required by the Americans with Disabilities Act from local zoning permit requirements. The Commission's change replaces a narrower reference to uncovered entry stairs and handicap ramps with broader language intended to ensure ADA-required modifications are not unnecessarily subject to local zoning review.
A member of the public had proposed adding a statutory reference to the ADA (42 U.S.C. § 12101 et seq.) so the general standards acknowledge applicable ADA requirements. The Commission instructed staff to add the agreed wording in Section 6.0(B)(6) and to include the federal citation in the draft before transmittal to the Selectboard.
