Denton trustees adopt municipal code codification, formally rescind prior annexation ordinance

The Village of Denton Board of Trustees on May 5 unanimously approved Ordinance 25-5-2 to adopt the Nebraska Basic Code of Ordinances, 2024, and moved to rescind the prior annexation ordinance adopted as Ordinance 24-3-1.

Trustee Doug Rosekrans moved to introduce and pass the codification ordinance and to waive the state statutory requirement for three readings; Trustee Amanda Fangmeier seconded and the motion carried unanimously. The board then approved Ordinance No. 25-2-1, revoking and rescinding the prior annexation ordinance for Lot 173, following the terms of the Conditional Annexation Agreement cited in the ordinance text.

The rescission ordinance instructs the clerk and appropriate departments to file and implement the repeal and requires the village to publish the ordinance within 15 days after passage. The ordinance text as adopted states the rescission takes effect on the fifteenth day after passage and publication. The board recorded unanimous votes on both measures.

The codification will replace prior local ordinance text with the standardized compilation produced by American Legal Publishing; trustees said the annual update aligns local code with recent state law changes. The actions mean the village will not proceed under the earlier annexation ordinance for Lot 173 unless and until a new, authorized development proposal is approved.
