Commissioner (speaker 6) moved to approve the application "with staff's recommendations, findings, and conditions," the motion was seconded and the chair announced the motion carries.
Staff member Corey, presenting the application, said the reduced setback responds to site constraints including steep terrain and mature pine trees and recommended approval "subject to the restrictions and conditions as outlined in Elko County code 4 9 5." During questions, commissioners and participants discussed utility easements and whether the proposed building would intrude into recorded easement areas; staff said typical utility easements run five feet along side property boundaries and 10 feet along front boundaries.
The applicant clarified site conditions during the hearing and provided verbal confirmation for the record. Staff reminded the applicant that the decision can be appealed to the Elko County Board of County Commissioners within 10 calendar days and that a building permit may be submitted prior to the appeal window but will not be processed until the 10 days elapse. The commission's approval is conditional on compliance with applicable provisions of the Nevada Revised Statutes, Elko County development criteria, and local building requirements.
