Council authorizes settlement with developer and property owner after executive session

City Attorney Joanna summarized the proposed settlement agreement between the developer (referred to as QMC/Cortera) and neighboring property owner David Grampa over appeals of a mixed-use permit previously approved by the city. Joanna told council that two appeals were dismissed for procedural insufficiency, one appeal from Mr. Grampa remained, and that the parties reached a settlement. "None of it is monetary on the part of the city," Joanna said, and recommended council approve entering the agreement and authorize the mayor to sign.
Council convened a 10-minute executive session under state law to consult with counsel and then returned to the public meeting. After the session the council voted to approve Resolution 1883 and authorized the mayor to execute the settlement agreement; the motion passed by voice vote. The settlement will proceed subject to the terms contained in the agreement and staff review for compliance with city authority.
