Rowlett staff move to repeal ambiguous 'minor modifications' provision in development code

City staff presented a proposal in a July 28 work session to repeal section 77-8-811 — the code provision on 'minor modifications' — saying the language is redundant with other review procedures and often applied subjectively. "This work session is intended to explain the amendment, discuss the reasoning behind staff's recommendation," staff member Allison Lisonbee told the commission.

Commissioners pressed staff for safeguards to ensure the repeal would not unintentionally remove public review. Commissioner Pollard said he did not "wanna see that given up," arguing the Planning & Zoning Commission exists so residents have input on what gets built. Staff responded that alternative landscape plans, planned-development amendments and board-of-adjustment processes would still provide formal review pathways and that staff research showed most past minor-modification cases had also required commission or council hearings. The commission asked staff to prepare a public-hearing draft for a future meeting and to clarify the code language to avoid bypassing boards.
