During public comment and follow-up discussion, board members and staff debated whether alleged code violations at the property should influence the zoning board's decision on area variances.
A board member asked counsel whether documented code violations could be grounds to deny a variance. Staff replied that it "depends on the type of violations" and whether they are connected to the variance request; temporary construction storage differs from ongoing use as a contractor's yard. "If it's temporary, that's one thing," staff said, "If it's kind of being used as a contractor's storage yard, that's part" of a different investigation.
The applicant's representative said the client would remove a product/container identified in the record and that he believed much of the work would be regularized with permits; the board agreed to request an interim report from the building department before making a final decision.
