Builder asks Elko County for three-month grace on 2024 code; county staff to return with options

Michael Stevens, representing VEK Construction, told the Elko County Board of Commissioners he and local production builders learned only recently that the county intends to require the 2024 building code for plan submittals beginning July 3, 2026, and that the short notice is disrupting projects that rely on master reuse plans.
"We are respectfully asking the commission to add an agenda item to next month's meeting to consider granting builders a 3 month grace period before the 2024 code becomes mandatory for plan submittals," Stevens said. He explained his firm had only about 2.5 months' notice and that water‑meter pit and NDEP timelines for some Spring Creek properties make updating master plans difficult in that window.
County staff said the code-adoption resolution passed in January set July 3 as the phase‑out date for the 2018 code and that notices went to contractors on the building department's mailing list in April. The board chair said an administrative grace period is likely an internal decision and promised to have staff return with options at the next meeting. The chair said they did not intend to penalize builders and asked Stevens to provide specific details about permitting or NDEP impediments so staff could address them.
The exchange concluded with the commission agreeing to place a follow-up item on the July 15 agenda to consider whether to grant temporary relief or other administrative measures to accept plans filed under the 2020/2018 code while contractors adjust.
