Commission reviews draft rule to require developer bonds for county road repairs

County Attorney Clyde Richard and staff briefed commissioners on a planning-and-zoning measure that would require subdivision developers to post a bond to cover potential damage to county highways from construction traffic. Richard said the county reviewed other jurisdictions and found few enforceable precedents but consulted with Williamson County officials and state highway representatives while drafting the proposal.
"If you pass this resolution tonight, the highway department will require a bond on the front end for repair of the county road because of that," Richard said. Commissioners asked who would oversee enforcement; Richard responded that the highway department and the highway superintendent would take and enforce the bond and determine repair work at project completion. The draft also includes consideration of traffic-study requirements and limits on flag lots; staff said further details will be developed with planning and zoning.
