Commission clarifies affordable‑housing code: Rice Creek Commons (TCAAP) exempt from new inclusionary zoning rules
The commission unanimously recommended an amendment clarifying that the City’s inclusionary housing ordinance (Section 1320.16) does not apply inside the TCAAP/TRC area; the Comprehensive Plan separately requires 20% of Rice Creek Commons housing be affordable at 60% AMI or less.

On July 8 the Planning Commission recommended approval of an amendment to Chapter 13, Section 1320.16, to clarify applicability: projects inside the TCAAP/TRC development area are exempt from the newly adopted inclusionary housing ordinance. Community Development Director Jacob Reilly explained the April 27 ordinance (2026‑007) was never intended to apply to TCAAP, which is governed by a separate TRC term sheet and a Comprehensive Plan goal requiring 20% of Rice Creek Commons units be affordable at 60% AMI or less.
