Commission revokes completeness finding in Ozaukee County CPCN docket amid extensive post-completeness changes

Chair Strand framed the issue for docket 137CE221 as procedural, not a merits determination of the Ozaukee County distribution interconnection project. He said the proceeding had become a "moving target" after the applicant filed or refiled 564 documents following the December 2025 completeness determination and staff issued 483 data requests. Strand warned that changes made after the draft environmental impact statement could deny the public the opportunity to weigh in on environmental impacts.

Strand proposed revoking the previous completeness determination, making an affirmative finding that the application is incomplete, closing the current docket, and requiring any future CPCN filing to be submitted in a new docket subject to a new completeness review. He emphasized this action should not be read as a rejection of the project's merits. Commissioners Nieto and Hawkins agreed and the commission voted to revoke the completeness finding. The commission then moved into closed session under Wisconsin Statute section 19.85(1)(g) to discuss unrelated litigation matters.
