Council reviews municipal code cleanups and chapter relocations
Summary
City staff told the Boardman City Council workshop that proposed edits to Titles 5, 8, 10 and 14 largely clean wording and relocate merchant and abatement rules so they align with Oregon statutes and centralize abatement procedures.
City staff presented a package of municipal code revisions intended to clarify where business, nuisance, traffic and sign rules live in the municipal code and to align local language with state law.
At the Aug. 4 workshop Staff member (S2) said, “The majority of the changes are just cleaning up the wording, making sure it aligns with ORS and current statutes.” The staff overview proposed moving merchant duties out of Title 8 (health and safety) into Title 5 (business regulations), relocating home-occupation rules from the development code, and consolidating abatement and lien procedures into a single chapter administered by the hearings officer.
Staff told the council that redline versions of the proposed language are in the agenda packet for more detailed review. The changes are largely editorial and organizational, staff said, but some shifts would change which office enforces a provision — for example, traffic and parking-related rules would be consolidated in Title 10 to make clear that the police department enforces those provisions under the cited ORS language.
Council members asked staff to ensure cross-references and notes accompany any relocated sections so members of the public searching the municipal code online can find rules that moved between chapters. Staff agreed to incorporate ordinance-history notes and to return proposed amendment language at a later meeting for formal action.
