Board accepts late Critical Area Commission letter into record; members question timing

During the Cox case, staff disclosed a Critical Area Commission letter that had been received the night before the hearing. The chair admitted the letter into the record as staff exhibit 11 after confirming all parties had copies that morning. Several board members expressed concern that the commission had not followed the board’s updated procedures for submitting exhibits in hybrid meetings and that receiving substantive comments shortly before the hearing hinders meaningful review.

Counsel (Lisa Sanders, S2) noted the board’s updated exhibit rules for hybrid hearings and cautioned that late submissions affect the weight the board can reasonably assign. Planning staff and the applicant agreed the CAC letter contained relevant items but observed that, given timing, only a small portion materially applied to the porch-only variance the board was being asked to decide. The board accepted the letter but discussed reminding external agencies to submit materials earlier to allow adequate review.
