WAG splits over 'agent' language as enforcement staff pushes for documented authorization

Members of the Wolf Advisory Group debated whether the WAC's phrase "an agent of an owner" should remain unchanged, be removed, or be limited to documented agents after WDFW staff warned of enforcement risks.

Producers and participants who patrol private lands argued that the term is needed to cover volunteers, neighbors, landlords and others who help manage livestock. "If you take out agent, how does somebody like that—how are they covered?" one participant asked, noting many helpers are not employees and may not use email or other documentation.

WDFW enforcement staff said open‑ended agent wording can be exploited after the fact and complicates enforcement of protections for an endangered species. The agency recommended some form of prior documentation or a narrowly defined, context‑specific term. "If agent was somehow [a] documented agent, I think that would be a lot clearer and easier for us to know," a WDFW enforcement speaker said.

Several group members pressed for options that balance immediate emergency responses (neighbors stepping in during an active attack) and safeguards against staged or premeditated killings; suggestions included substitute words such as "representative," "delegate," "volunteer," or a narrowly scoped definition that requires preexisting ties to the operation.
