Council hears first reading to add minor conditional-use permit option for small projects

City planning staff presented a first reading of an ordinance to amend the development code to define a "minor conditional use permit" and add it as an entitlement process for projects that involve no new building or construction. Lisa Warner, associate planner, said the process is designed to help small business owners move into existing buildings by reducing fees and removing engineering review where it is not needed.
Warner explained that the streamlined minor-CUP would still be considered by the planning commission and that appeals would follow the same process as a regular CUP. Councilwoman Zaberski asked about the appeal process and the differences between discretionary ("may") and mandatory ("shall") language in code; City Attorney Aaron Mortensen and Interim Chief Development Officer Michelle Rambo clarified that an appeal to council remains available and that "may" is discretionary while "shall" is mandatory in legal code language.
