CMS tightens third‑party intermediary rules, extends TPI notification deadline to Dec. 31

Aug 12, 2026

CMS proposed clarifications for third‑party intermediaries (TPIs), tighter audit-sampling rules for small intermediaries, required participation plans for inactive TPIs, and an extended deadline for clinicians to report TPI non-submission from November 1 to December 31 of the data year.

The full story

John Jenkins presented several proposed policy changes affecting third‑party intermediaries that submit MIPS data to CMS. Among the proposals: clarify the levels at which performance feedback should be provided (individual clinicians, groups, virtual groups, subgroups, and APM entities); hold updates to public 'qualified posting' information until scheduled posting cycles; require full data-validation audit sampling when a TPI submits data for fewer than 10 QPP participants; and require a participation plan from TPIs that did not submit data in the year preceding their self‑nomination.
