Resident challenges code-enforcement notice; council instructs manager to seek clarification

Resident Robert Fernsler raised a code-enforcement dispute during the public-comment period on Nov. 4, contending that a Warning Notice posted by Code Enforcement Officer David McDermott on Nov. 3 incorrectly listed several violations.

Fernsler told council the house has visible four-inch house numbers and said the dumpster cited is on land he owns on North Cyrus Street. He also disputed that his roof/deck and railing required a permit, said hollyhocks in his garden should not be treated as weeds, and objected to the 15-day compliance window because he did not know the specific violations. Fernsler also criticized McDermott’s demeanor. After discussion, "Code Enforcement Officer is to enforce IPMC violations, not zoning or permitting violations," and council instructed the borough manager to contact McDermott, ask for clearer violation descriptions, and provide Fernsler an additional 15 days to address the violations.

Council did not indicate in the minutes that the Warning Notice was rescinded; rather, they directed staff to clarify and extend the compliance period while the manager consults with the code officer.
