Commission backs three‑year pilot to exempt minimum lot‑size rules in Urban Service Area

The Planning Commission voted to recommend a county‑initiated land‑development code amendment that would create a temporary exemption from minimum lot‑size square‑footage requirements inside the Urban Service Area.

Staff explained the draft creates a new LDC section (proposed §4.1.6) establishing eligibility and standards for exemptions, with an expiration date of Dec. 31, 2030 unless the Board of County Commissioners extends the pilot. The policy would not waive setbacks, building separations, height limits or lot widths and explicitly excludes agricultural zoning, planned developments, flood‑prone properties and parcels on septic. Staff told commissioners the intent is to streamline situations where small urban lots are otherwise forced into a lengthy rezoning process; staff emphasized safeguards so exemptions cannot be used to increase density or intensity above what is allowed by the zoning district or future land‑use category.

Commissioners asked staff to check consistency with adjacent municipalities and requested an administrative application process with clear review criteria; after those clarifications the commission voted 5–1 to recommend the pilot approach be forwarded to the county commission with suggested refinements.
