Working group recommends dedicated education fund from pilot payments for nonrecurring school expenses

The working group proposed a dedicated education fund to receive a portion of pilot payments so that abatements do not reduce funds available for schools. The recommendation defines the education fund as a vehicle for nonrecurring expenses such as capital projects or facilities work.

Members debated whether to treat the payment as an additional amount or as a reallocation of the abated portion; the draft settled on structuring required payments so counties receive a stable education contribution tied to pilot payments rather than relying on the commission to offset any maintenance-of-effort shortfall. Under the working draft, a formula example discussed would allocate roughly 44% of the pilot payment to the education fund (as part of the minimum 45% payment pilots must make).

Regina Newman warned the group about statutory constraints and urged legal review, saying the commission determines the tax-rate allocation. The panel emphasized that the education fund is intended for nonrecurring expenses and that the final language should reference the existing county education fund that already restricts use to nonrecurring items.
