Planning commission backs county text amendment to implement state compatibility rules

The Palm Beach County Planning Commission on Aug. 14 recommended approval of a county-initiated text amendment to add objective compatibility criteria for residential-to-residential land-use decisions, a change staff said is required by recent state legislation.

Brian Davis, principal planner, told the commission the amendment responds to House Bill 399 and implements statutory compatibility factors into the county's future land use element and LDRs. "This is the sum total ... of what compatibility is in the Florida statutes under chapter 163," Davis said, and staff proposed two new policies: one to guide future land-use determinations and one to anchor the zoning code language that will follow. Davis explained the amendment lists evaluation factors—land use designations of adjacent parcels, development potential and density, physical integration and design, setbacks, buffering and mitigation measures—and said the staff recommendation is for approval to meet the statute's effective date of 01/01/2027.

Commission members asked how the county would treat statutory exceptions (military, airports, planned developments and historic districts), whether the plan-level language should say "may" versus "shall," and how the new criteria would interact with more detailed zoning review. Davis and planning staff said the amendment focuses on residential-to-residential compatibility and that zoning-level regulations will provide the finer, enforceable measures. The motion to recommend approval passed unanimously.
