Staff urged denial, citing code consistency and precedent risk

City staff presented the board with photos, slope measurements and code context and recommended denying the requested encroachment for a 5-foot fence at 469 Ramsgate Drive. Staff emphasized the city's effort to bring multi-frontage lots into compliance and said the requested 34-foot encroachment would be "substantial."

Staff noted that in 2023 the code was amended to raise allowed front-yard fence height from 42 to 48 inches and to allow a 20-foot encroachment for double-frontage lots. Staff told the board it would be defensible to permit a 20-foot encroachment in this case while rejecting a larger encroachment that could set an inconsistent precedent. "We...did not feel that criterion was met," the staff member said, summarizing analysis on slope, prior use and alternatives.

Board members pressed staff on where a 20-foot encroachment would fall relative to the patio and sight lines; staff answered that a 20-foot encroachment would allow access to rear doors and patio while retaining more of the required setback. The board ultimately weighed that staff position against applicants' claims of uniqueness and approved the applicants' requested plan.
