Supervisors debate whether courthouse grounds rules should be a policy or ordinance

County staff presented a draft document governing use of the Tama County courthouse grounds. Supervisors discussed whether the document should remain a policy—easier to change and implement—or be adopted as an ordinance, which would provide clearer enforcement authority but would require public hearings and be harder to modify later.

One supervisor said, "I would be happy to do this as a policy, but I still think we need to challenge a couple of things 1st before we go forward with it," signaling concerns about language that references the entire courthouse building and enforcement sections that assume ordinance-level powers.

Points of debate included whether the county could enforce trespass or obstruction if the document remains a policy, whether the chief judge's guidance limits local authority in specific courthouse spaces, what the permit threshold should be (25, 50, 75 or 100 people), and whether bandshell/bandstand events require separate city/county coordination. Supervisors noted Benton County and other nearby jurisdictions use application forms, waivers and sometimes insurance requirements for larger events.

County staff suggested the document could be approved as a policy now and redlined later after legal review; several supervisors preferred starting with policy language so events scheduled this summer could be administered without delay. No ordinance was adopted during the meeting; staff will return redlines and legal guidance for clarification.
