Parowan council denies Legacy B Estates PUD, keeps site R-3

The Parowan City Council voted 3-2 on Aug. 17 to deny a conditional-use request for the Legacy B Estates planned-unit development, concluding an extended discussion about water rights, ownership, density and numerous variances the developer sought. Council member Barton moved to deny the PUD and keep the property under R-3 standards; Council member Dean seconded, and the motion carried.

Council debate centered on water-rights priority dates, the proposed master-meter plan, open-space shortfalls, and the scale of variances requested. Council members expressed concern the PUD would rely on too many departures from the city's standards. As one council member summarized the motion on the floor: "I would say that... it would stay at an r 3 and that we would deny their application for PUD." The motion passed with the council recording three ayes and two nays.

Why it mattered: the denial means the developer cannot proceed under the PUD route and must either redesign to comply with R-3 subdivision standards or return with changes the council can accept. Staff said the council's decision ends the PUD avenue but leaves standard subdivision or other compliance paths open.

What happens next: Dan, the city staff lead on the file, said the city will withhold residential building permits until required water-right transfers and technical plan approvals are complete. Developers can pursue a standard subdivision under existing code or negotiate a revised agreement for future council consideration.
