Committee advances bill to update Idaho commitment rules for mental illness and neurocognitive disorders

Sponsors say the bill updates definitions, adds rebuttable presumptions, and creates pathways for community-based treatment and holding procedures for people with neurocognitive disorders.

Representative Brandon Mitchell introduced House Bill 614, telling the committee the measure "modernizes Idaho's mental health and development disability laws to the 21st century." The bill, Mitchell said, updates definitions to reflect current medical understanding, prioritizes treatment over incarceration, and emphasizes placing people in "the least restrictive appropriate setting, community based, supervised housing whenever possible."
