Commission tables comprehensive plan amendment for Old Black Colony Road properties

The Planning & Zoning Commission tabled (unanimous) a comprehensive plan amendment request (CPA 26‑01) for approximately 9.849 acres at 945 Old Black Colony Road after extended discussion about density, compatibility and the absence of annexation and zoning applications.

Staff explained the applicant proposes to change the future land use designation for two properties currently in Buda’s extraterritorial jurisdiction (ETJ) from primarily 'residential neighborhood' (3–6 du/acre) to 'residential mixed density' (8–12 du/acre) to support a potential future annexation and an R4 zoning request. Staff cautioned that a future land use map amendment is guidance only and does not itself change zoning or obviate the need for annexation; zoning cannot be adopted while the property remains in the ETJ.

Commissioners pressed the applicant and staff for details. One commissioner said he could not "understand an argument for increased density, to the level of 12 dwelling units per acre," citing concerns about traffic on Old Black Colony Road and compatibility with surrounding uses. Applicant representative Oscar Herrera said the applicant’s intent is to pursue R4 if annexed but that the land use change does not guarantee zoning approval.

After discussion of options (approval, denial, or table), a motion to table the request was made, seconded and approved unanimously. Tabling keeps the request active and allows the applicant to pursue annexation, submit zoning or PD applications, or return with more detailed materials for commission consideration.
