Advisory commission urges clearer flowchart and a county code-enforcer role to close enforcement gaps

Commission members told staff the patchwork of letters, hearings and referrals has left residents uncertain where to send complaints and left staff uncertain who enforces structural code violations. "We've kind of done a poor job of that over the years," one commissioner said, noting repeated resident complaints about unsightly or unsafe properties. The commission discussed a three-part approach: clarify which complaints rise to public-health intervention (mold, vermin, sewage), which require a building- or code-inspection for structural unsafety, and which require commissioners to pursue court-ordered abatement.

Members repeatedly returned to the need for a county-level code enforcement officer who could conduct inspections, coordinate with the sheriff for court-ordered entry and file enforcement actions if owners fail to comply. Commissioners said other jurisdictions (Scottsburg, North Vernon and Austin) use code-enforcement staff and asked county staff to collect job descriptions and procedures from those counties. The commission asked county counsel, the health department and the area plan director to produce a complaint-handling flowchart that lists the intake form, the triage steps (health vs. buildings), and the point at which the advisory commission must refer a case to the Board of County Commissioners for legal action.
