Consultant recommends removing agricultural exemption from Wellhead Protection ordinance; second reading tabled

Liberty Flora of Intera presented the second reading of Ordinance 2026-7, describing changes made to reduce ambiguity and recommending a substantive clarification: she urged removing the current exemption for agricultural uses so that agricultural activities that fall under commercial or industrial categories (for example, large-scale tanks, fuel storage or confined feeding operations) would be subject to the ordinance's upgrade requirements. "Intera's recommendation is to remove that exemption so that agricultural uses falling under the commercial and industrial category would be subject to the same upgrade requirements as other covered uses," Flora said, and she clarified the change would primarily affect new agricultural uses.

Commissioners discussed the policy trade-offs; Commissioner Kirsch supported the recommendation, citing modern agricultural operations that resemble industrial uses, while Commissioner Collier asked to see the revised language before voting to avoid imposing undue burdens on the county's agricultural sector. Flora agreed to provide specific proposed language to county staff prior to the next meeting. The Board voted to table the second reading.
